These Terms of Service (“Terms”) govern your access to and use of the Who Won It mobile application (the “App”) operated by Who Won It (“we,” “us,” or “our”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. We may suspend or terminate accounts that we reasonably believe belong to users under 13.
The App includes public chat rooms where you can post messages, images, and other content (“User Content”). You retain ownership of your User Content. By posting, you grant Who Won It a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content within and in connection with the App, including for moderation, safety, backups, and promotion of the App.
Messages you post are visible to other members of the room and to our moderation systems and staff.
You agree not to post, transmit, or share content that:
You also agree not to attempt to bypass moderation, rate limits, blocks, mutes, bans, or any technical measure used to enforce these Terms.
We use a combination of automated tools (including AI-based moderation and profanity/slur filters) and human review. Violations may result in message removal, warnings, temporary mutes, temporary or permanent chat room bans, account suspension, or account termination — at our sole discretion and without prior notice. Repeat or severe violations may be reported to law enforcement.
To report content or a user, use the in-app report tools. To appeal a moderation action, contact nycchefsaiollc@gmail.com.
You will not:
You may delete your account at any time from within the App. Deletion is immediate and irreversible. We may suspend or terminate your account at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT USER CONTENT WILL BE ACCURATE OR APPROPRIATE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHO WON IT AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE APP. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE APP WILL NOT EXCEED USD $100.
You agree to indemnify and hold harmless Who Won It from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your User Content, your use of the App, or your violation of these Terms or any law.
If you download the App from the Apple App Store, you acknowledge that these Terms are between you and Who Won It, not Apple, and that Apple is not responsible for the App or its content. Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. Government prohibited or restricted parties list.
We may update these Terms from time to time. Material changes will be announced in the App or by email. Continued use of the App after changes take effect constitutes acceptance.
These Terms are governed by the laws of the United States and the state in which Who Won It is established, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located there, unless required otherwise by applicable law.
