This Privacy Policy describes how Who Won It (“Who Won It,” “we,” “us,” or “our”) collects, uses, and shares information when you use the Who Won It mobile application (the “App”). By using the App you agree to this Policy.

1. Age Requirement

Who Won It is intended for users who are 13 years of age or older. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us information, contact us at nycchefsaiollc@gmail.com and we will delete the account and associated data.

2. Information We Collect

• Account information: email address, password (hashed), and, if you use Apple Sign-In, the identifier Apple provides.
• Profile information: display name, username, bio, avatar image, and notification preferences.
• User-generated content: chat room messages, room memberships, reactions, mentions, reports you submit, and blocks you create.
• Device information: device model, operating system version, app version, push notification tokens, and basic diagnostic logs.
• Safety data: moderation strikes, mute/ban status, and records related to reports of abuse.

3. How We Use Information

• Provide, operate, and maintain the App and chat rooms.
• Authenticate you and secure your account (including MFA for administrators).
• Deliver push notifications you have enabled.
• Enforce our Terms of Service and Community Guidelines, including automated and human review of reported content, profanity/slur filtering, and rate limiting.
• Detect, prevent, and respond to fraud, abuse, and security incidents.
• Comply with legal obligations and respond to lawful requests.

4. Chat Rooms Are Public to Members

Messages you post in a chat room are visible to every other member of that room and to our moderation systems and staff. Do not share information in chat rooms that you want to keep private. Your username, display name, and avatar are visible to other users of the App.

5. AI and Automated Moderation

To keep the community safe, chat messages may be evaluated by automated systems (including AI models operated by our infrastructure providers) for profanity, slurs, spam, harassment, and other policy violations. Automated decisions may result in content removal, warnings, temporary mutes, or account restrictions. You can appeal moderation actions by contacting nycchefsaiollc@gmail.com.

6. How We Share Information

We do not sell your personal information. We share information only with:

• Service providers that host our backend, deliver push notifications, provide AI moderation, and provide bot/abuse protection, under confidentiality obligations.
• Other users of the App, to the extent you post content or share profile information within the App.
• Law enforcement or authorities where required by law or to protect the rights, safety, or property of Who Won It, our users, or the public.
• Successors in the event of a merger, acquisition, or sale of assets, subject to this Policy.

7. Data Retention

We retain your account information and content for as long as your account is active. When you request account deletion in the App, your public data (messages, memberships, device tokens, preferences, strikes) is deleted immediately and your login record is removed in the same request. Backups and moderation/audit logs required for safety and legal compliance may be retained for a limited additional period.

8. Security

We use industry-standard safeguards including encrypted transport (HTTPS), row-level security on our database, restricted administrative access with multi-factor authentication, and continuous security scanning. No system is perfectly secure, and we cannot guarantee absolute security.

9. Your Rights and Choices

• Update your profile and notification preferences in the App.
• Block other users or report content directly in the App.
• Delete your account from the App settings; deletion is immediate.

10. International Users

The App is operated from the United States. If you use the App from outside the United States, you consent to the transfer and processing of your information in the United States and other countries where our service providers operate.

11. Changes to This Policy

We may update this Policy from time to time. Material changes will be announced in the App or by email. Continued use of the App after changes take effect constitutes acceptance.
